These Terms of Service (“Terms of Service”) govern the access or use by you of applications, websites, content, products, and services (the “Services”) made available by Texas Power & Lighting (“TPL ENERGY,” “we,” or “us”). PLEASE READ THESE TERMS OF SERVICE CAREFULLY BEFORE ACCESSING OR USING THE SERVICES. Your access and use of the Services constitutes your agreement to be bound by these Terms of Service, which establish a contractual relationship between you and TPL ENERGY. If you do not agree to these Terms of Service, you may not access or use the Services. TPL ENERGY may amend these Terms of Service from time to time. Amendments will be effective upon TPL ENERGY posting of such updated Terms of Service at this location. Your continued access or use of the Services after such posting constitutes your consent to be bound by the Terms of Service, as amended.

Description of Service

TPL ENERGY will legally act on your behalf as an authorized agent regarding the selection of, enrollment for, or contract execution of a product or service offered by a retail electricity provider (REP), including electricity service.
You provide TPL ENERGY with the information necessary to enroll you in electricity contracts with REPs, including personal information such as name, address, phone number, email address, date of birth, social security number, among other required information.
TPL ENERGY may request and receive your historical usage data for the previous 12 months from the Transmission and/or Distribution Service Provider (TDSP), including Smart Meter Texas (SMT) account setup and permission for SMT third party access.
TPL ENERGY may communicate and negotiate with Retail Electricity Providers (REPs) on your behalf.
TPL ENERGY is acting as an agent only and is not responsible for the actual delivery of electricity nor can we guarantee the service provided by the 3rd party REP.
As a 3rd party, TPL ENERGY is not liable to the customer for disputes between the customer and REP for matters related to billing, service, or other obligations relative to that contract.
You understand that TPL ENERGY is acting as an agent only and you are ultimately responsible for payment to the REP. TPL ENERGY will attempt to set up your online account with the REP and will communicate information regarding your service via email correspondence. In the event the setup was unsuccessful, we will communicate any further action needed on your part to complete the setup process.
Brokerage Compensation: TPL ENERGY maintains a broker relationship with the REPs listed on this website. REPs compensate TPL ENERGY for enrollments based on future customer electricity usage, an upfront commission amount, or a combination of both.
Permitted Use
You agree that you are only authorized to visit, view and to retain a copy of pages of the Site for your own personal use, and that you shall not copy, modify, download, publish or otherwise distribute the material contained on the Site for any purpose other than for personal use, unless otherwise specifically authorized by us to do so. You also agree not to deep-link to the Site for any purpose, unless specifically authorized by us to do so. The content and software on this Site are the property of TPL ENERGY and is protected by U.S. and international copyright laws.
Limited License
You are granted a limited, revocable, non-exclusive and non-transferable license to utilize and access the Site pursuant to the requirements and restrictions of these Terms of Service. TPL ENERGY may suspend, change, or discontinue any aspect of the Site at any time. TPL ENERGY may also, without notice or liability, impose limits on certain features or services and restrict your access to any or all portions of the Site. You shall have no rights to the proprietary software and related documentation, if any, you are provided in order to access the Site. Except as provided in these Terms of Service, you shall have no right to use, own, loan, sell, rent, lease, license, sublicense, copy, assign, translate, modify, improve, adapt, or create any new or derived works from, or display, distribute, perform, or in any way exploit the Site, or any of its contents (including software) in part or in whole.
Violation of the Terms of Service
You understand and agree that at TPL ENERGY’S sole discretion, with or without prior notice, TPL ENERGY may terminate your access to the Site, or exercise any other remedy available and remove any unauthorized user information, if TPL ENERGY believes that the user information you provide is a violation or is inconsistent with these Terms of Service, or violates the rights of TPL ENERGY, or any 3rd party, or violates the law in any way. You agree that monetary damages may not provide a sufficient remedy to TPL ENERGY for any violation of these Terms of Service and further you consent to injunctive or other equitable relief for such violations. TPL ENERGY may release user information about you if required by law or subpoena.
Representations By You
By visiting the Site, you represent, warrant and covenant that (a) you are at least 18 years old; (b) that you are a resident of the United States; and (c) that all materials of any kind submitted by you through the Site will not violate, plagiarize, or otherwise infringe upon the rights of any 3rd party including trade secret, trademark, copyright, trade dress, privacy, patent, or other personal or proprietary rights.
License Granted by You
By providing content or data to us, including by the submission or uploading content or materials for use on the Site, you represent and warrant that you or the owner of all rights to such content or materials has expressly granted us an irrevocable worldwide right in perpetuity to use and exploit all or any part of the content and materials provided by you.
